In 2006, Learning Rights filed a class action lawsuit with its co-counsel, Disability Rights Center, on behalf of nine students with disabilities against Montebello Unified School District. The complaint alleged that the District failed to provide adequate placements and Individual Transition Plans for the nine students represented by Learning Rights. Learning Rights was able to obtain the much-needed services for the students as required by law. In addition, as a result of settlement negotiations, the District was required to improve their policies relating to all future students’ Individual Transition Plans.
The lawsuit sought injunctive relief to ensure that these siblings and all other similarly situated foster children are not summarily denied the right to attend public school with non-disabled and non-foster youth, as well as general and punitive damages for the effect that this restrictive educational setting has had on the Plaintiffs.
